Do-over for Port of Oakland Commission nominations takes place at Tuesday's Council meeting

As a result of a major snafu by the Oakland City Council, the appointment of Jakada Imani and Victor Uno to the Port of Oakland Commission will now go back in front of the Council this Tuesday for a "do-over" vote.

Earlier this month, City Council voted to appoint Imani to replace Margaret Gordon and reappoint Uno to the Port of Oakland Commission. However, that vote came during a confusing session that may have violated the Brown Act.

There were more than 60 people signed up to speak, but there was confusion after Council President Larry Reid asked other Councilmembers if they wanted to go ahead and vote - given the fact they reviewed the appointment two previous times and there was a large number of speakers. Council then followed by quickly approving the appointments.

In a memo addressed to Mayor Jean Quan, Reid and the Council, Oakland City Attorney Barbara Parker said the Council must "cure and correct" its vote on the appointments.

"Given the confusion in the chamber and timing of the vote, we conclude that public speakers on both sides of the issue were not given a clear opportunity to speak before the Council voted on the item as required by the Sunshine Ordinance and Brown Act," Parker memo read.

According to Parker, the Council's action's were in effect, null and void.

"It is of the utmost importance that citizens have a voice in the business conducted on their behalf by the Council," she wrote. "To fully comply with the requirement that the public has a meaningful opportunity to address the Council before it takes action, this item must be re-noticed to “cure and correct.”"

Parker's memo was in response to a Council subcommittee asking the City Attorney's office if Council gave all public speakers the opportunity to speak prior to taking action on the appointments as required by the Sunshine Ordinance and the Brown Act.

The Port of Oakland appointments have been contentious from the start, pitting most of the Oakland City Council against Mayor Jean Quan.

While many Councilmembers said they admire and respect Imani - the executive director of the Ella Baker Center - they do not like the way Quan has treated Gordon during the nomination process. According to some City Council members, Quan informed Gordon she would not be nominated via email. In addition, some members charge that Quan is not even returning the phone calls of the celebrated West Oakland environmentalist.

Quan has strongly disputed allegations that Gordon was treated unfairly. Uno's reappointment has not attracting controversy, but he is included in the motion, which Council acted on. Uno is a long time labor leader in Oakland.

Imani's assistant at the Ella Baker Center said he is out of town and unavailable for comment. Councilman Reid said the Council will once again vote on the  appointments this Tuesday. It will be the fourth time this item will go before Council.

Of course. The way this was handled was obviously illegal. I was stunned, watching it. At least one speaker AFTER THE VOTE HAD ALREADY BEEN TAKEN made good points about why the council could have voted not to confirm Imani based on his lack of qualifications. (Council members claimed before the vote that their hands were tied, even though all of them preferred Gordon, because they were limited to confirming or not confirming Imani based on qualifications.) The speaker laid out Imani's lack of qualifications for the appointment. But it was too late. The council had already voted.

The sheer stupidity and incompetence of this council continues to astound.
